Final Practice Making Efficiency (LEVEL THREE) Arguments

Two years ago, a Hofstra University student, named Danmell Ndonye, falsely accused five men of rape, because she feared being branded a tramp according to her boyfriend (Fasick 6). You may research this past current event if you need more background information. Should a person who falsely accuses another person of rape be given the same consequence / punishment received by someone convicted (of actual rape) in a real Court of law. Consider how such an action would influence the life of the person making the false accusation, the life of the person falsely accused, and the running both the university and the larger city.

I believe a person who accuses any one of a false crime should receive the same level of punishment or greater. The reason being is because there have been past cases in America where people swear the oath of telling the truth and as result death acquires to the defendant accused of something that never happened. For example Troy Davis v. State of Georgia case. "The defense presented affidavits from seven of the nine trial witnesses whose original testimony had identified Davis as the murderer, but who it contended had changed or recanted their previous testimony. Some of these writings disavowed parts of prior testimony, or implicated Sylvester "Redd" Coles, whom Davis contended was the actual triggerman. (New York Daily News)" I'd say the reason why Davis was not granted another stay was because of the testimonies received. This case shows the possible results of a false testimony. Now those who falsely testified against Davis well now have to face the guilt of his life. This case would probably make some re-think their testimony in any trial because there is no turning back. Once a person is charged, trialed, convicted and sentenced; they lose, just like one of the men accused in the Hofstra rape according to the NY Post "The father said his son had received a letter from his employer, Cablevision, telling him he had been fired. But late last night, a Cablevision spokesman told The Post he would be reinstated." This is what happens when a false statement is given; the defendant loses his job, his college tuition, his family, friends who do not want to be around him, years of his life, or his life straight up. These are the reasons why i believe someone who makes false accusations should be charged heavily with the same consequence or grader.

I partially agree with Marvin, sometimes people swear on the oath of telling the truth and as aresult people is either put to death or spend their life kin jail for a crime they didnt commit. The system is so messed up right now they people are in jail for a crime they didnt do , and there are people outside that actuaklly committed a crime but walked away being free. For someone to lie because of them making a stupid mistake should recieve some type pf punishment. With this particular situation i dont believe that the female should get the same punishment as the five boys woluld've gotten, but she should recieve some type of punishment. Ok, yes she lied, but should she relly be in jail for 25 years just for a lie? I dont think so. Maybe 1-5 years but i feel that 25 years is a harsh punishment. Look at all these other cases thats going on America. ait all depends on who you know and who you are. For example the Sean Bell shooting, because they were police officers they got off easy. Or what about the OJ Simpson trial, it was hard to prove that he did commit the murder of the two victims. In these cases no they didnt lie but people that committed thye crime walk away while people who didnt do crimes are behind bars. is this what the world is coming too?

When a male attempts to rape a female and is fought off, not completing the rape, he WILL be prosecuted for attempted rape even if he is "troubled" and "needs much help." I doubt that anyone here can find a news story about a mentally imbalanced man who escaped prosecutio­n after raping or trying to rape someone. So why the double standard? Isn't it about time that women who do bad things get the same punishment as men? The woman who falsely accused three Duke lacrosse players of rape is walking around free. It was just luck and the ability to afford a good defense that kept these guys from serving a long, long sentence. What both of these women did is very much like shooting at someone and just happening to miss. The Nassau County DA is showing a strong bias in favor of females by "consideri­ng" bringing charges. If the Hofstra accuser is not brought to
justice, the message sent to other troubled women everywhere is that charging innocent males with rape is a no-lose situation. Either you "get" them or you don't, but you escape any prosecution yourself. On top of that, the DA and media may not even print your name. And if you're really troubled, you may not care about your reputation if you're revealed as a false accuser. So if they falsely accused someone of committing a felony, they should be prosecuted to the fullest extent of the law. Doing so can minimize attempts of getting back on someone, by having him/her arrested for no reason whatsoever.

Being convicted of rape is a serious matter, and or is consequencely a life altering conviction. Rape is viewed as one of the most hanis crimes a human can commit. If being charged with rape for the first time, you face the charge first-degree rape, if convicted you can potentially face twenty-five years in prision. Now imagine facing the charge of first-degree rape and knowing that consequenses if your convicted. the next twenty-five years of your life are now taken from you for a crime you didn't commit. For example, the incident that happend on the Hofstra University campus, freshman Danmell Ndonye falsely accused Tavera, Felipe, Rondell and Jesus of raping her. These innocent boys were about to spend about one-fourth of their lifes in prision, all becasue Danmell didn't want the title of being the whore on the Hofstra University campus. A person that falsely accuses another of raping someone should face the minimal charge of doubling the conviction of the wrongfully accused, becuase whos to say that person will not accuse others of the same charge now they know they can get away with it. Consequencely putting in prision innocent people recking their lives because one person didn't want to stand behind their actions. If rape is considered one of the most hanis crimes to commit, falsely accusing someone of rape should be treated with a more severe consequence. The point of prision is to teach a person a lesson for what they did, and if your willing to wrongfully accuse someone of rape you obviously didn't learn that lesson. So their should be a greater conseuqence for falsely accusing someone of rape.

Before I began my statement, this is my own statement. I agree with with Marvin. A crime is a crime. When you are called to the stand you are ask "Do you SWEAR to tell the Truth and NOTHING but the TRUTH". So, if you tell a lie after giving your oath you should be giving the same punishment as someone who exactly commited to the crime. By given false statements you can but someone's life on the life. Not only should the person who gave a false statement recieve the same pushiment as if they comminted tot crime, they should be required to seek mental help. You have ruined someones whole life. They now have a reprentation as a rapist,know one wants to hire them and everyone will have the wrong inpressing of them. Just because a false statement was given, the Hofstra student lost EVERYTHING.For the reasons stated above i believe that anyone that gives a false statement should face punishment.
